Sole proprietor wins Supreme Court case against tax office

The Supreme Court took the side of the individual entrepreneurs Tatsyana Palyakova, who had sued the tax office.

According to onliner.by, the story began as long back as the end of 2015. Employees of the tax office declared the invoices from the Russian company "Comfort", presented by the SP, as counterfeit and confiscated her goods. Also, they were going to do the same with the proceeds and impose a fine.

The Economic Court of Minsk found the actions of the tax office legal. In court, the tax inspector said: Palyakova admitted that she bought them at the market. The businesswoman said that the inspector threatened her and forced her to write it.

All in all, the officers seized 64 pairs of shoes for the amount of 11 million rubles. Also, she could face the confiscation of 14.1 million rubles of proceeds for the sold shoes and a fine of 30 to 50 base units. According to estimates of most entrepreneurs, she could lose about 30 million rubles.

But at the court meeting of March 14, the Supreme Court overturned the verdict of the Minsk Economic Court. As Palyakova said, she is to get her goods back, the goods returned and the penalty abolished.

The Supreme Court decision has not yet entered into force. The tax office has 10 days to appeal.
